Ashborn Partners Privacy Policy

Ashborn Partners LLC ("Ashborn," "we," "us," or "our") respects your privacy and is committed to being transparent about how we collect, use, disclose, share, retain, and protect personal information.

This Privacy Policy applies to information collected through Ashborn Partners websites, landing pages, online forms, advertisements, home energy review services, the Ashborn Partners Utility Bill Analyzer, the Ashborn Partners Home Water Analyzer, free home water test requests, appointment scheduling, water related communications, water service referrals, telephone communications, text messages, emails, and related services (collectively, the "Services").

It also describes our use of Meta Pixel and other cookies, pixels, tags, local storage, and similar technologies, how we honor Global Privacy Control signals, and how you can opt out of advertising related sale, sharing, or targeted advertising. Ashborn does not currently use the Meta Conversions API or any other server side transmission of website events to Meta.

By using our Services or providing information to us, you acknowledge the practices described in this Privacy Policy.

2. Information We Do Not Intentionally Request Through Our General Lead Forms

How the Analyzers Handle Information

Utility Bill Analyzer. To use the Utility Bill Analyzer, you provide your first and last name, the street address, city, state, and ZIP code of the home, your telephone number, and, if you choose, your email address. When you continue past that first step, Ashborn receives this contact information, along with a record of the consent you gave and the page you were on, so that Ashborn and its participating providers can contact you about your results and related options for your home as described in our Terms of Service. The utility company name is optional and is entered in a later step. The bill amounts and electricity usage you enter are analyzed in your browser and are not uploaded to Ashborn. While you work, the analyzer may save your entries in your browser's session storage so they are not lost if the page reloads; this copy stays on your device and is removed when you close the browser tab or select "Clear All Data." The analyzer may record your state, ZIP code, utility company, and anonymous activity (for example, that a report was completed) using a random session identifier, to understand regional energy trends and improve the tool. Your name, telephone number, email address, and street address are not included in that anonymous activity record; they are received separately, as described above. Your contact details are not saved in your browser's storage.

Home Water Analyzer. To build a report, the analyzer sends the ZIP code and selected water system to Ashborn's website services, which look up public records. The analyzer may record anonymous activity, such as the ZIP code entered, the public water system viewed, and which buttons were selected, using a random session identifier. It does not record your name, telephone number, email address, street address, or answers about your home in that activity data.

Water test requests. When you submit a free home water test request, the information you submit, a summary of the report you viewed, your optional answers, and a record of your consent (including the consent language, its version, and the time of submission) are transmitted through Ashborn's website to a spreadsheet Ashborn uses to manage and schedule requests.

4. Advisor Appointments and Free Home Water Tests

If you submit information through Ashborn, an Ashborn agent will contact you first, and we may schedule you for a telephone, virtual, or in-person appointment with an Advisor, based on what you need and what is available in your area.

The Advisor may review information regarding your home, utility costs, energy usage, goals, and available service options.

The purpose of the Advisor appointment is to help identify options that may be appropriate for you and provide an opportunity to determine what, if anything, you would like to explore further.

Free Home Water Tests

If you request a free home water test through the Home Water Analyzer, Ashborn receives your request and schedules your appointment. The test itself is performed through a laboratory at Enevive, LLC. Enevive may also discuss water filtration, treatment, conditioning, or related water services with you.

The Home Water Analyzer report is based on publicly available records about public water systems. It is not a laboratory analysis of water taken from your home. Ashborn does not receive laboratory results, treatment recommendations, or later water test results from Enevive.

Information shared with Enevive is described in the "Enevive, LLC (Free Home Water Tests)" part of the How We Share Personal Information section below.

5. How We Share Personal Information

Ashborn may disclose personal information to third parties when reasonably necessary to operate our Services, fulfill your requests, conduct our business, or as otherwise permitted by law.

If you request a free home water test, Ashborn shares information with Enevive, LLC so that Enevive can contact you, schedule, and perform your test. Enevive may receive:

Enevive, LLC is an independent participating service provider and is not an employee, subsidiary, governmental agency, utility company, or laboratory operated by Ashborn Partners LLC. Once information is provided to Enevive, Enevive may process that information according to its own privacy practices. Please review the Enevive Privacy Policy (opens in a new tab).

This transfer is made to fulfill the water test you requested. It is not stopped by a Global Privacy Control signal or an advertising opt out, because it is needed to provide the service you asked for. You may ask Ashborn not to share your information with Enevive by not submitting a request, or by contacting us before your appointment is scheduled.

Lead Generation and Referral Relationships

Ashborn operates, in part, as a lead generation and referral business.

Ashborn may receive compensation from a participating provider when we refer a consumer, provide consumer information, schedule an appointment, generate a qualified lead, or when another agreed upon business event occurs.

Depending on applicable law, certain transfers of personal information to participating providers in exchange for monetary or other valuable consideration may be considered a "sale," "sharing," or similar disclosure of personal information.

California Residents

Ashborn does not sell raw California consumer leads to unrelated companies for their independent marketing purposes.

For California consumers, Ashborn handles everything in house. Ashborn generates the opportunity, and Ashborn representatives qualify the homeowner and manage the relationship directly. Ashborn does not transfer raw California consumer leads to unrelated companies for those companies' own independent marketing purposes, and does not receive compensation for doing so.

Ashborn may still provide appropriate information to approved installation companies, financing providers, service providers, contractors, and fulfillment providers when that is reasonably necessary to evaluate, quote, finance, process, install, fulfill, support, or service something a California consumer asked for. That is a disclosure made to carry out your request, not a sale of your information to a third party for that party's own marketing.

Ashborn may receive compensation in connection with products, services, sales, installations, completed transactions, and other legitimate business relationships.

Advertising technology is treated separately. Meta Pixel may operate for California visitors who have not sent a Global Privacy Control signal and have not opted out. Depending on applicable law, those advertising disclosures may be treated as "sharing," "targeted advertising," or a "sale" of personal information even though Ashborn does not sell raw consumer leads. California residents can opt out at any time on our Do Not Sell or Share My Personal Information page, and a Global Privacy Control signal is honored automatically.

Residents of Other States

Outside California, Ashborn's business model may involve providing qualified consumer leads or appointment information to participating third party home service providers.

In those states, Ashborn may receive monetary or other business consideration in connection with certain referrals or lead transfers.

Certain privacy laws may define these activities as a "sale" or "sharing" of personal information even when Ashborn does not traditionally sell a database containing personal information.

Depending on your state of residence and applicable law, you may have the right to request that Ashborn not sell or share your personal information.

Consent given through the website home request form allows Ashborn Partners and its participating providers to call, text, and email you at the number and email you provided about your request, including scheduling and confirming your appointment, and related options for your home, including by automated technology or prerecorded voice where permitted by law. Consent is not a condition of purchase.

Consent given through the free home water test request is limited to Ashborn Partners LLC and Enevive, LLC contacting you to schedule and follow up about your requested home water test and related water service options, including by automated dialing or text messaging technology where permitted by law. It is limited to live calls, calls and text messages using automated dialing or text messaging technology where permitted by law, and email, about water testing and water services. It does not cover marketing for solar, batteries, HVAC, home energy, or other unrelated services.

Consent to receive marketing calls or text messages is optional and is not a condition of purchasing property, goods, or services.

8. Text Message Opt Out

You may opt out of marketing text messages at any time.

9. Email Opt Out

Marketing emails sent by or on behalf of Ashborn will provide a method for requesting that future marketing emails stop.

You may click the unsubscribe link contained in a marketing email, or email lead-intake@ashbornpartners.com to request removal from Ashborn marketing email lists.

Opting out of marketing emails does not necessarily prevent Ashborn from sending nonmarketing communications that are necessary to respond to a request, administer an appointment, provide legally required notices, or otherwise manage an existing relationship where permitted by law.

10. Telephone Do Not Call Requests

You may ask Ashborn not to make future marketing telephone calls to you.

Ashborn also uses first party browser storage for its own features, such as remembering an advertising opt out on this browser (a setting named ashborn_ad_optout), saving Utility Bill Analyzer entries during a session, remembering the reference number of your analyzer request for that session, and keeping a random identifier for anonymous analyzer activity.

12. Meta Pixel and Advertising Technologies

Ashborn Partners LLC uses Meta Pixel and may use related Meta advertising technologies to measure website activity, understand advertising performance, attribute leads and appointments to advertising campaigns, measure conversions, build or manage advertising audiences, prevent fraud, improve marketing, and display relevant advertising where permitted by law.

Depending on the visitor's browser, device, privacy settings, consent choices, and interactions with the website, Meta Pixel may receive information such as an Internet Protocol address, browser and device information, page visits, button clicks, form interactions, referral information, campaign information, cookie identifiers, Meta click identifiers, conversion events, and other website activity.

What our website currently sends. Meta Pixel is installed on the public pages of our website, including the Utility Bill Analyzer and the Home Water Analyzer. Our code sends a standard "PageView" event once each time a page loads. When a request is submitted through our home energy lead form (on our homeowner pages, the Utility Bill Analyzer, and our state landing pages), our code also sends a standard "Lead" event. On our state landing pages, our code also sends a "ViewContent" event when the page loads and a custom "LeadStart" event when the form is first opened. These events include only the page's name, a content category, and the state abbreviation, and on state landing pages the LeadStart and Lead events also include a request reference number generated by our website so the same request is not counted twice. Meta's own software may also automatically detect certain page information and button clicks. Our code does not send Schedule or Purchase events, does not send a Lead event for Home Water Analyzer requests, and does not send the names, telephone numbers, email addresses, street addresses, ZIP codes, utility bill amounts, uploaded bills, water results, or other form answers you enter. Ashborn does not currently use the Meta Conversions API.

Meta may process information received through Meta Pixel according to its own terms and privacy practices. Ashborn Partners LLC does not control all independent processing performed by Meta. You can learn more in the Meta Privacy Policy (opens in a new tab).

Depending on applicable law, certain disclosures made through advertising technology may be considered targeted advertising, cross context behavioral advertising, sharing, or a sale of personal information even when Ashborn Partners LLC does not sell a traditional consumer list.

Ashborn Partners LLC provides applicable consumers with methods to opt out of qualifying sale, sharing, or targeted advertising activities, including our Do Not Sell or Share My Personal Information page. Ashborn Partners LLC also honors legally recognized browser based opt out preference signals, including Global Privacy Control, as described below.

Ashborn may use other advertising technologies, such as tags, conversion tracking tools, and campaign attribution technology, to determine whether an advertisement resulted in a website visit, form completion, lead submission, appointment, or other conversion activity, and for analytics, audience measurement, campaign performance, retargeting where applicable, fraud prevention, and security. Where a third party provides one of these technologies, that provider may process information according to its own privacy policy. The specific technologies in use may change over time; this section will be updated when they do.

13. Global Privacy Control and Browser Privacy Signals

Global Privacy Control is a browser or device based signal through which a consumer may communicate a request to opt out of certain sale, sharing, targeted advertising, or cross context behavioral advertising activities.

When Ashborn Partners LLC receives a valid Global Privacy Control signal through a supported browser or device, Ashborn will treat the signal as an applicable request to opt out of advertising related sale, sharing, targeted advertising, or cross context behavioral advertising for that browser or device, as required by applicable law.

When a valid Global Privacy Control signal is detected, Ashborn Partners LLC will suppress Meta Pixel and other nonessential advertising tracking associated with the browser or device. Where applicable, Ashborn will also suppress corresponding server side advertising events.

Ashborn applies this to every visitor whose browser or device sends the signal, not only to residents of particular states, and does not require an additional form before honoring it. On our website, the signal is checked before Meta Pixel can load. If the signal is present, Meta Pixel is not loaded, no Meta events are sent, and Meta cookies previously set by this website are removed. Ashborn uses the signal only to honor your choice. It is not used for advertising, fingerprinting, or profiling.

Honoring the signal does not prevent the website from working or stop services you request. For example, if you request a free home water test, your request is still sent to Ashborn and Enevive, LLC so the test can be scheduled, but it is not reported to Meta.

Global Privacy Control generally applies to the browser or device transmitting the signal. If a consumer uses another browser or device, the consumer may need to enable the signal again or submit a separate privacy request.

You can also opt out manually on our Do Not Sell or Share My Personal Information page. A manual opt out is saved on that browser and is applied the same way as a Global Privacy Control signal.

Traditional Do Not Track Signals

Traditional Do Not Track signals are different from Global Privacy Control. Ashborn Partners LLC may not respond to traditional Do Not Track signals unless required by law, but it honors legally recognized Global Privacy Control signals as described in this Policy.

Third Party Tracking

Ashborn Partners LLC may use analytics, advertising, conversion measurement, and similar technologies provided by third parties.

Depending on the technologies being used, these providers may collect information regarding a consumer's interaction with Ashborn Partners' website, advertisements, or digital services.

Ashborn retains personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including:

Certain records, including consent and opt out records, may be retained for extended periods when reasonably necessary to demonstrate compliance with applicable law.

Retention also supports honoring communication suppression requests. If you ask us to stop contacting you, we generally need to keep enough information to recognize you and avoid contacting you again.

For that reason, a deletion request does not always mean every record is erased. Where applicable law requires or permits Ashborn to retain certain information, including suppression, Do Not Call, and consent records, that information may be retained.

When personal information is no longer reasonably necessary, Ashborn may delete, anonymize, aggregate, or securely dispose of it.

Ashborn uses reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, destruction, or misuse.

Florida residents may have additional rights under applicable Florida privacy laws where those laws apply to Ashborn.

These may include rights concerning access, correction, deletion, obtaining copies of information, and opting out of certain uses or disclosures of personal data.

Illinois Residents

Illinois residents may have rights under various state privacy and data protection laws.

Ashborn does not intend to collect biometric identifiers such as fingerprints, retina scans, iris scans, or similar biometric identifiers through its standard homeowner lead generation Services.

If Ashborn later introduces technology involving regulated biometric information, separate notices and consents will be implemented where required.

Ohio Residents

Ashborn protects personal information relating to Ohio residents and will comply with applicable state requirements concerning the security of personal information and notification of qualifying security breaches.

Residents of Other States

Consumers residing in other states may have additional rights under applicable state privacy laws.

Ashborn will process legally valid requests according to the law applicable to the consumer and Ashborn.

California Online Privacy Protection Act

The California Online Privacy Protection Act requires operators of commercial websites that collect personally identifiable information from California consumers to provide certain disclosures regarding their privacy practices.

This Privacy Policy describes the categories of personal information Ashborn Partners may collect, the purposes for which the information may be used, the categories of parties to whom information may be disclosed, the choices available to consumers, and how consumers may contact Ashborn Partners regarding their information.

California Lead Handling

For California consumers, Ashborn Partners' current operating model is to generate and manage consumer opportunities through Ashborn Partners and its representatives rather than sell raw California consumer leads to unrelated third parties for those third parties' independent marketing purposes.

A California consumer who requests information from Ashborn Partners may communicate directly with an Ashborn Partners representative regarding products and services that may be relevant to the consumer's request.

Ashborn Partners may disclose information to approved installation companies, financing providers, service providers, contractors, fulfillment providers, and other participating providers when reasonably necessary to evaluate, quote, finance, process, install, fulfill, support, or provide a product or service requested by the consumer.

Ashborn Partners may receive compensation in connection with products, services, customer acquisition activities, sales, completed transactions, installations, referrals, or other legitimate business relationships.

Digital advertising and analytics activities are addressed separately in this Privacy Policy. California law may treat certain advertising related disclosures differently from traditional transfers of consumer leads.

California Consumer Privacy Act

The California Consumer Privacy Act, as amended from time to time, applies to businesses meeting certain statutory requirements.

22. Non Discrimination

Where prohibited by law, Ashborn will not unlawfully discriminate against a consumer for exercising an applicable privacy right.

Exercising certain rights may affect Ashborn's ability to provide a particular service when the information involved is reasonably necessary to provide that service.

For example, requesting deletion immediately after requesting a provider referral may prevent Ashborn from completing that referral.

23. Children's Privacy

Ashborn's Services are intended for adults.

We do not knowingly solicit personal information from children under 13 through our general Services.

Ashborn's homeowner qualification and referral Services are intended for individuals who are at least 18 years old.

If we learn that personal information from a child was collected inappropriately, we will take reasonable steps to delete it as required by applicable law.

If Ashborn becomes aware of a security incident involving personal information, we will investigate and take appropriate steps based upon the circumstances.
